30/06/2008 Complainant/s By:- IP Opposite Party:- Perused the complaint and the documents. The complainant has invested Rs.50,000/- with the opposite party. He has produced receipt to that effect. This investment is made on 23/5/2005. It is the case of the complainant that the opposite party has not refunded the amount with interest. Therefore, he has sought for directing the opposite party to refund the amount of Rs.50,000/- with interest. Number of complainants have been filed against the opposite party. It is said that opposite party is lodged in Central Prison, Bangalore in connection with several complaints filed against him. Criminal cases also booked against the opposite party for cheating and misappropriation of deposit amount. The complainant who has invested Rs.50,000/- with a fond hope that he may get interest out of the deposit amount. But unfortunately the opposite party had cheated so many persons who have deposited the amount. Several complaints are also filed before the Consumer Forum against the opposite party and orders have been passed against opposite party to refund the amount with interest. The opposite party has not complied the orders. Therefore, he is in Central Prison in connection with so many cases. Under these circumstances, it would be just proper and reasonable to allow the present complaint also directing the opposite party to pay Rs.50,000/- along with interest. In the result, I proceed to pass the following:- ORDER 1. The complaint is allowed. The opposite party is directed to pay Rs. 50,000/- along with interest at 10% p.a on the said amount from 23/5/2005 (date of investment) till payment/realization. 2. Send the copy of this Order to both the parties free of costs immediately. MEMBER MEMBER PRESIDENT
