Today, learned counsel Sh. Gaurav Sharma on behalf of the appellant has appeared before the Commission, whereas respondent No. 1 – Ms. Varsha Gupta has appeared through video conferencing. None has appeared on behalf of respondent Nos. 2 & 3 inspite of sufficient service.
On the previous date, i.e., 26.04.2024, a compromise (Paper No. 54) was submitted on behalf of the appellant and respondent No. 1, which was read over and explained to the appellant and respondent No. 1, who after reading, understanding and perusing it, accepted the compromise and the same was kept on record.
The said compromise entered into between the appellant and respondent No. 1 has been slightly modified and now it has been agreed that the appellant will pay sum of Rs. 25,500/- to respondent No. 1 in lieu of the mobile handset in question. Rest of the terms and conditions of the compromise have been affirmed by the appellant and respondent No. 1.
The agreed amount of Rs. 25,500/- has been transferred by Sh. Gaurav Sharma, learned counsel for the appellant via Google Pay from his mobile No. 9411119967 to the Google Pay Account of respondent No. 1 on her mobile No. 9568883354. The respondent No. 1, who has appeared through video conferencing, has accepted the terms of the compromise and acknowledged the receipt of the aforesaid amount of Rs. 25,500/-.
In view of above, the appeal is decided in terms of the compromise (Paper No. 54), which shall form part of the order. Costs made easy.
The amount deposited by the appellant with this Commission, be released in its favour.
File be consigned to the record room along with copy of this order.
A copy of this order be sent to the concerned District Commission for perusal, information and necessary action.
