ORDER

Case called out.  Both counsel for the complainant and Ops are present.  Complainant, OP No.1 present and OP No.2 absent, however Counsel for the OP No.2.  Further, both parties submitted the joint memo stating that, they have amicably compromised the matter in view of the compromise OP No.2 has agreed to pay a sum of Rs.4,00,000/-.

 The OP No.1 has acknowledged the receipt of the D.D.s  bearing No.267905, dated 16.01.2015, for an amount of Rs.2,50,000/- and D.D. bearing No.005875, dated 13.01.2015, for an amount of Rs.1,50,000/-.  Further, the OP No.1 has acknowledged the receipt of total amount of Rs.4,00,000/- by way of said D.D.s. Also complainant acknowledged the receipt of bubble top mould along with hot runner and temperature controller.  

  Counsel for the OP No.2 present and submitted that complainant has already paid an amount of Rs.2,89,000/- which is paid by the OP No.2 and in turn  in favour of OP No.1 by way of above said Demand Drafts.   Hence, both parties submitted that, they have no rival claims against each other and prays for dismissal of the complaint in terms of the joint memo.

         In pursuance of the above said joint memo the complaint is accordingly disposed off.
