The car of complainant bearing no.DL8CD2638, duly insured with OP, was stolen on the night of 22.08.07. He informed the police on 23.08.07, informed OP and submitted in due course all documents like FIR, police untraceable report etc, wanted, but no response was received. He filed this complaint. They filed a reply stating that claim was closed, as complainant failed to file documents on demand. No evidence of such demand of documents was filed by it. Its evidence was closed. There is no other dispute. The reply is sketchy and without any substance or merits. We are clearly of the view that OP has committed deficiency and holding it guilty of it, we direct OP to pay IDV of Rs.45,000/- to complainant along with interest of 9% from date of claim with OP till payment. We award Rs.20,000/- for deficiency and litigation expenses.

The order shall be complied with within 30 days of the receipt of the copy of the order; otherwise action can be taken against OP under Section 25 / 27 of the Consumer Protection Act.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
