The complainant a firm, who had taken a comprehensive insurance coverage for his vehicle bearing no.DL-1LC-2482 for the period coverage from 12.10.07 to 11.10.08. The vehicle was stolen in the intervening night 20.08.08 to 21.08.08, FIR & untraceable report already annexed with complaint as per Exh.D. Subsequently a legal notice was also served to OP on 10.01.09 as per Exh.E. Thus complaint was filed.

OP has taken a stand in W.S Para1 that final report has not been filed by police official; however, there is no dispute over FIR even after filing W.S. OP remained absent. Ultimately OP’s defense was struck off.  

OP has further admitted that FIR states that documents were in vehicle but has doubted the truth of the statement and there was a violation of conditions of policy.

Nonetheless, the theft occurred on 20.08.08 and FIR was lodged on 27.08.08 which indicates a delay of 7 days. This delay has not been explained by Complainant either in his pleading or hi correspondence with OP.

We therefore, find no deficiency in service and complaint is dismissed.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
