We are not opining for or against the ex gracia payment ordered to be paid to the petitioner.

We agree with the view taken by the State Commission that the petitioner is not entitled to the benefit under the policy for the reason that the body of the deceased was cremated without getting the postmortem done, lodging of FIR and informing the insurer immediately after the accident to enable the insurance company to ascertain the cause of death. Dismissed.
