M.A. No.279/2012 By this application complainants seek to amend the prayer clause as under: (i) To direct the opposite party to handover the possession of flat no.1503, 14th Floor, Building no.17, admeasuring 1877 square Feet, Type W1-3B in the residential complex, named as resco Nirvana Countryin terms of letter of allotment. (ii) To award a compensation of Rs.15,00,000/- for undue hardships, mental and physical agony and tension to the complainant/petitioner, due to negligent and deficient services of the Respondents. OR Alternatively award an interest @ 18% per annum from the agreed date of possession i.e. 25.06.2010 till the date of possession. (iii) To award the cost of Petition to the petitioners. (iv) To provide any other relief that may be deem fit and proper in the facts and circumstances of the present case. Learned counsel for the OP no.1 and 2 states, though OP no.1 and 2 dispute the allegations made in the application for amendment, they have no objection if the amendment is allowed without prejudice their rights and pleas In view of the above, the application is allowed. Amended complaint be filed within four weeks. List before the Registrar on 24.05.2013 for completion of formalities of recording of evidence.
