Learned counsel for the complainants seeks to withdraw this complaint in view of the settlement arrived at between the complainants and opposite party No.1 in Company Petition No.167/2013 titled as Hitendra Mahajan & Anr. Vs. M/s Unitech Ltd. with liberty to revive the complaint in the event of opposite party No.1 failing to abide by the settlement between the parties as recorded in the order dated 2.9.2013 of the Honle High Court. Counsels for opposite parties have no objection to this conditional withdrawal. In view of the above, complaint is dismissed as withdrawn with liberty to the complainants to revive the complaint if the opposite party No.1 fails to abide by the settlement between the parties.
