It is stated by learned counsel for the parties that the parties have made amicable settlement of the subject matter of the present complaint in the following manner:- -2- (i) The opposite party-Builder has agreed to allot an alternative flat bearing No. 704 in Tower No. 14 in Unitech Habitat at Greater Noida to the complainant. (ii) The sale price of the said alternative flat would be the same as was the original basic sale price fixed for the original flat, being Rs.3050/- per sq. feet. (iii) The opposite party will give proportionate rebate for the reduced area in the alternative flat to the complainant. (iv) The penalty of Rs.5/- per sq. ft. per month for the period of delay will be payable by the opposite party w.e.f. 25.05.2010 till the date of actual possession to the complainant. (v) The opposite party shall send all the requisite documents to be signed by the complainant within 15 days from today and on completion of the same by the complainant, the possession shall be handed over within next 45 days. -3- (vi) The parties will comply with the other terms and conditions of the original agreement in regard to the payment of other dues. The complaint is disposed of in terms of the above settlement, leaving the parties to bear their own cost. Dasti. |
