The complaints of deficiency against the OP1  & OP2 are that on the representation of OP1, a real estate consultant, a plot was booked with OP2, in Dehradun Santour City-II stated to be developing after all approvals & permission of Govt. bodies. The Complainant deposited Rs.5,20,000/- against booking of a 200 sq. yd. plot till 2008. Later on it came to notice of complainant that there was no development and a notification of Mussorie Development Authority published in newspaper informed that there was no approval for any project in this area. The complainant requested for cancellation of booking and return of money, by legal notice. The OP1 was proceeded exparte, while OP2 filed a reply which is totally sketchy without any substance, and admits the fact of no approvals or no development.

We have considered the evidence of complaint & material on record and find that OP2 in collusion of OP1 promoted and marketed plots and collected bookings for plots in area not approved by authorities. They indulged in unfair trade practices and committed deficiency by not returning the money. We direct OP2 to return Rs.5,20,000/- with interest of 9% p.a. from date of deposit and pay Rs.50,000/- as compensation for unfair trade practice and deficiency, including litigation expenses to be paid by both OP1 & OP2 jointly & severally.

        The order shall be complied within 30 days of the receipt of the copy of the order; otherwise action can be taken under Section 25 / 27 of the Consumer Protection Act.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
