As per last order, service by dasti notice was ordered to be effected upon respondent no.1. Dasti notice has been duly served upon respondent no.1. Affidavit to this effect has been filed by the official of the petitioner. We are satisfied that respondent no.1 has been duly served. Since none is appearing on behalf of the respondent no.1, it is proceeded exparte. Vide impugned order dated 14.11.2011 passed by the State Commission the appeal filed by the petitioners was dismissed in default as none of the parties were present before the State Commission on that date. For the reasons mentioned in the revision petition and to have a decision on merits, the impugned order passed by the State Commission is set aside. Accordingly, the matter is remanded back to the State Commission to decide the appeal afresh after hearing all the parties concerned, in accordance with law. With these observations, revision petition is disposed of. Parties are directed to appear before the State Commission on 07.10.2014. Dasti. |
