ORDER

Heard Counsel for the Complainant who is not able to satisfy the Commission relating to cause of action as referred in paragraph-25 of the complaint wherein it is stated that the cause of action for filing the present complaint arose in October, 2009 when the Complainant became aware that the Opposite Parties nos.1 and 2 have in total violation of their contractual obligations, i.e., releasing the goods without obtaining the original bills of ladings, have caused loss at Rs.1.115 crore to the Complainant. Admittedly, the goods were dispatched somewhere in October to November, 2007. Learned Counsel for the Complainant states that Complainant had in fact taken up the matter with the consignee- Opposite Party no.3 and he wants to place all correspondence on record in support of the plea relating to cause of action. Learned Counsel for the Complainant states that he would like to file appropriate documents in support of the paragraph no.25 relating to cause of action and as such he wants to withdraw the complaint seeking liberty to file fresh complaint with all the relevant documents supporting the statement in paragraph 25. Liberty, as prayed for, is granted. The complaint is allowed to be withdrawn in aforesaid terms.
