           The complaint pertains to delay in payment of retirement dues. The short facts are that complainant retired on 31/3/2009 and Rs. 3,50,000/- was paid as gratuity on next day of retirement.  Balance amount of gratuity alonwith PF and GSLL was held back as complainant was still in occupation of staff quarter.  He was finally paid on vacation of staff quarter.  He prays for interest on the amount.

         OP in its pleadings has contended that OS (Office of Secretary) has directed that gratuity has to be paid according to rules and all other benefits to be retained till vacation of staff quarter.  Complainant was paid Rs. 3,50,000/- on 31/3/2009 for gratuity Rs. 9,21,49/- on 11/5/2009 Rs. 80,000/- on 12/5/2009.  Other payments were withheld according to OS Manual 2007 relating to withholding of retirement benefits on occupation of staff quarters.  The complainant was paid remaining amount by cheque dated 11/6/2010 after vacation of staff quarter on 18/5/2010.

         We have perused the pleading of both parties.  The complainant appears to be misconceived at inception.  The public section units are bound by rule and regulations.  Having occupied the staff quarter after retirement for personal reason, the complainant cannot seek Redressal for OP’s following laid down rules and procedures OP was well within its right to pay the remaining amount on vacation of staff quarter.   The complaint being devoid of merit is dismissed.

         File be consigned to records.

Copy of the order be sent to the parties free of cost.
