The Complainant had booked 3 tickets vide PNR no.2135367029 for travel on 02.06.12 in Rajdhani Express from Nizamuddin to Raichur in Class III A/C under waiting list 3,4,5 but complainant could not cancel the ticket in specific time same day due to ill health. However, on 4th June 2012, complainant filed TDR in Nizamuddin but staff refused to accept and advised him to approach New Delhi Railway Station. He went to concerned counter but clerk of counter rejected his request stating that the amount of waiting list ticket is not refunded consequently Complaint was filed and OP counsel, Mithilesh Singh, filed vakalatnama but proceeded exparte on 02.11.12.
As per exparte evidence, it is very much transparent that the amount of waiting list tickets is has been withheld by Railway Authority against the rules. The ticket pertaining for Rajdhani Express vide train no.12430 from Nizamuddin to Raichur costed Rs.5,835/-. Complainant also exchanged several mails to DRM, Customer Care, AGM, EDPG, Status report of PG Portal but no officer co-operated him despite several efforts. Even executive Director of Railway remained silent on his part where as it is admitted facts that waitlisted ticket amount is being refunded to consumers.
Holding OP guilty, we direct DRM, New Delhi to refund the amount of Rs.5,835/- under instruction to Chief Commercial officer refund and we also award Rs.5,000/- as litigation and harassment compensation.
The order shall be complied within 30 days of the receipt of the copy of the order; otherwise action can be taken against OP under Section 25/27 of the Consumer Protection Act.
File be consigned to record room.
Copy of the order be sent to the parties free of cost.
