We have considered the exparte evidence of complaint & heard submission. His complaint is that he booked a flat bearing no. A/GF-60, Parsvnath Paradise, Mohan Nagar, Ghaziabad, and approached Tata Home Finance ltd. for loan, and deposited Rs.6,500/- a processing fee. He was assured of loan, but loan was not sanctioned. He also paid additional Rs.9,80/- for interest, for delay in disbursement of loan. He cancelled the booking. The OP has not appeared on notice.

We have considered the evidence on record. The OP has not deferred or explained the facts as to why the loan could not be sanctioned. OP has issued no letter of inability or reason to complainant for non sanction of loan. It should have explain the complainant, if the processing fee was not refundable. In this circumstances, we hold OP liable and direct it to return Rs.6,500/- + Rs.9,80/- and pay Rs.5,000/- for deficiency and litigation expenses.

The order shall be complied within 30 days of the receipt of the copy of the order; otherwise action can be taken against OP under Section 25 / 27 of the Consumer Protection Act.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
