Order No. 01 Dated – 28.12.2021

            Dhr Amarendra Kumar Roy files an application u/s 25 and 27 of the CP Act, 1986 and the same is registered as EA-44/2021. It appears from the order dated 07.12.2021 passed by the Forum in CC-468/2021 that the judgment was passed by this Forum on 07.12.2021 directing the OP to refund Rs. 7,75,933.55 only as booking money along with SI @ 5% PA with effect from the date of payment till realization along with a litigation cost of Rs. 3,000/- and the OP was directed to comply the order within 60 days from the date of passing of the judgment. Fact remains that the said 60 days has not yet been elapsed and the execution case should be filed after 06.02.2022 and as such the matter is a premature one.

In view of the above, the question for issuance of notice to the Jdr does not arise. Hence, the execution case is rejected. The execution case being No. 44/2021 is thus disposed off. Record of the execution case need not be placed in Ezlash on 14.02.2022.
