ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:

                                                                                    JUDGMENT

            Complainant has filed this consumer complaint U/s.35 of C.P. Act, 2019 seeking following reliefs;

            “Direct the opposite party to disburse Rs.89,056/- to the account of the complainant vide A/c No.0613050011796 of United Bank of India, Paradeep Branch”.

            The brief fact of the case is that, the complainant was working in the ESSAR Project India Ltd. at Paradeep under M/S Swain Brothers as a Senior Electrician and working from 20.8.2009 to 30.4.2015 and the total full and final remuneration of that period was Rs.1,24,056/- and out of that amount the opposite party paid a sum of Rs.50,000/- through bank draft on 13.12.2019. The complainant did not receive the rest amount of Rs.74,056/-  from the opposite party towards his remuneration and on repeated request by the complainant till date the opposite party did not pay the said amount.

            Notice was issued to opposite party by Regd. Post on 10.4.2021 but opposite party is absent and having set ex-parte on 25.5.2022.

            Dispute relates to payment of remuneration/wages by opposite party to complainant. This Commission has no jurisdiction to adjudicate any matter with regard to employer and employee relationship. As such this Commission has no power to entertain this case. Hence the consumer complaint is dismissed. However liberty is given to complainant to approach appropriate Forum if so advised. No cost.
