Complainant purchase d one camera pen from op 1 for a sum of Rs.2,100/- vide Bill No.238 on 18.6.14. It is stated by the Complainant that OP had also issued to her certificate of Guarantee Card along with the Bill of Camera Pen.
It is alleged by the Complainant that after few days of purchase the aforesaid Camera Pen did not function properly and stop working. Hence, she visited the shop of OP on 13.7.14 and requested to rectify/repair the same.
It is further alleged by the Complainant that the representative of OP itself opened the Camera in her presence for rectification, but instead of repairing it, he damaged it and asked the Complainant to come after 3-4 days.
Complainant approached OP several times to get the Camera Pen replaced/or to get the amount refunded, but every time OP flatly refused to do so, rather insulted the Complainant. Hence this complaint.
Notice of the Complaint was sent to the OP through Regd. A D Post for 9.1.15. Since none appeared on behalf of OP, it was ordered to be proceeded with ex-parte.
Complainant has filed her evidence by way of affidavit. She has placed on record the copy of Invoice dated 18.6.2014, and the certificate of Guarantee Card duly filled by the OP in support of her case.
We have heard the arguments advanced at bar and have pursued the record.
From the un-rebutted testimony of the complaint as well as the documents placed on record, we are convinced that the strong put forth by the Complainant is true. The bare perusal of the Certificate of Guarantee Card makes it clear that OP ought to have repaired/replaced the alleged Camera Pen, as it is covered under the Guaranty period. OP failed to do so.
In view of the above facts and circumstances we hold we, hold OP guilty of deficiency in service and direct it as under:-
1) Pay to the complainant a sum of Rs.2,100/- as a cost of Camera Pen with simple interest @10% p.a. from date of filing complaint till its recovery.
2) To pay to the complainant a sum of Rs.1500/- for mental agony trauma suffered by her which will also include cost of litigation.
The order shall be complied with within 30 days of the receipt of the copy of the order. If the said amount is not paid by the OP within a period of one month from the date of receipt of this order, the same shall be recovered by the complainant along with simple interest at the rate of 10% per annum from the date of this order till recovery of the said amount of Rs. 1500/–. This final order be sent to server (www.confonet.nic.in ). A copy each of this order each be sent to both parties free of cost by post.
