The complaint pertains to deficiency in service The complainant, a retired personnel from Central Government service, received pension from OP-2 through OP-1 bank. He received Rs.20,095/- instead of Rs.20,096/- in months of July and August,2013. He alleges that pension for Rs.20,095.20/- was rounded off to Rs.20.095/- and not to Rs.20,096/- as per circular bearing No.42/2/97 –P&PW(G) of Ministry of Personnel, PG & Pensions dated 27.0.1997 which has been annexed.
OP-1 has filed a letter sent by OP-2 affirming that as the dearness allowance was Rs.8931.20/-, he was wrongly being paid Rs.8932/- from January,2013 and the amount will be deducted from pension. Thereafter the pensioner started receiving one rupee less for a next two months.
We have perused the pleading, and circular annexed. Clause 1.2 of said circular states “Payment of Dearness Relief involving a fraction of a rupee shall be rounded off to next higher rupee In the light of above circular, OP-2 action was erroneous as regard to rounding off Rs.8931.20/- to Rs.8931/- when it has been precisely and clearly affirmed by Min. of Personnel, Public Grievances & Pension circular that fraction of rupee had to be rounded off to next higher denomination.
We, therefore, hold OP-2 guilty of imperfection in service and direct it to pay Rs.2/- to the pensioner. We also award Rs.2,000/- as compensation for deficiency, harassment, mental agony due to imperfection in service inclusive of litigation expenses.
The order shall be complied with within 30 days of the receipt of the copy of the order; otherwise action will be taken under Section 25 / 27 of the Consumer Protection Act.
File be consigned to record room.
Copy of the order be sent to the parties free of cost.
