We have considered the exparte evidence of complainant alleging deficiency on the part of OP in raising unnecessary and illegally demand from Complainant and harassment faced by complainant from OP and its executives/muscles man/ recovery agents.
The evidence shows that complainant was using the credit card of OP with ending no.7283 and till July 2006, all bills were paid and nothing was due. After paying the amount of Rs.7,805/- on 05.08.06, for bill dated 28.07.06, Complainant requested OP to cancel the aforesaid card and did not received any statement after August 2006. Suddenly in the month of April 2010, an amount of Rs.11,000/- in question was demanded from Complainant as outstanding of aforesaid card by OP and its agent on phone but complainant refused to pay and asked OP and its agent to provide the detailed statement of card. It is also alleged that Complainant was repeatedly threatened, abused in filthy and derogated language by the recovery agents/executive of OP on phone and physically causing harassment and mental agony to Complainant. Thus, Complainant filed this complaint seeking directions for restraining the OP and it’s executive from threatening calls, raising illegal demands and compensation for mental agony, harassment etc.
OP has failed to appear despite notice and was proceeded exparte on 17.10.11.
In the circumstances, we accept evidence of complainant, and direct OP to pay Rs.3,000/- as compensation harassment, mental agony inclusive of litigation expenses.
The order shall be complied with within 30 days of the receipt of the copy of the order; otherwise action can be taken against OP under Section 25 / 27 of the Consumer Protection Act.
File be consigned to record room.
Copy of the order be sent to the parties free of cost.
