Present: Counsel for complainant and OP.

 

The complainant was a Govt. teacher. She had applied for loans for various purposes in different banks in Delhi and bankers have informed her that there are some outstanding dues against her name as per information from CIBIL. On enquiry she came to know that some over due of Rs.3,10,849/- was shown  with status of written off. She sent a notice to CIBIL asking to furnish information on which she came to know that a credit card bearing No.101156190012015 was issued some time in 1998 which was disputed by complainant as actually no credit card was issued to her.  Therefore she was aggrieved that by action of Bank informing CIBIL about default status and she called the OP to give correct information as no credit card was issued or received by her name.  OP in its reply has stated that from the earlier bank ANZ Grindlay bank had issued a Visa Silver card issued to complainant and subsequent to its merger with Standard Chartered Bank the credit card and its dues were transferred to the OP.  OP further stated that complainant made some transactions but no outstanding were shown in the monthly statement.  Despite her asking information on transactions etc, no transactions were shown and information was sent to CIBIL, in due course about the non-payment.

The Counsel for OP has submitted that OP in order to resolve the issue has now issued a zeroised due statement to CIBIL, to resolve the issue.

In the light of this fact, the matter stands resolved but the same has been done in 2015 after the litigation by complainant in 2011 till now.  Keeping this in view, we award a compensation of Rs.15,000/- including harassment and litigation expenses.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
