The short grievance of the complainant is against debit of Rs.6,000/- on 12.05.09 from his SB account for a transaction on debit card no.4763382020423332, at a ATM, though he had not used the card to avoid transaction charges of Rs.50/- on each transaction. He produced the statements which shows no transaction fee of Rs.50/- yet it show debit of Rs.4,000/- and Rs.2,000/- on same day with transaction charges. He states it to be illegal. He gave a legal notice, bank asked him to wait. But nothing happened and this complaint is filed.

The OP in its reply has stated that transaction cannot be without use of debit card and pin no. in possession of complainant. It stated that it obtained journal copy of the transaction a proof of transactions, but did not file in evidence the journal so relied by it.

In view of the OP failing to produce evidence in support of its plea, we hold that OP illegally debited the account of complainant, and hold it guilty of deficiency.

We award a lump sum compensation of Rs.12,000/- inclusive of illegally debited amount and award Rs.3,000/- as litigation expenses.

  The order shall be complied with within 30 days of the receipt of the copy of the order; otherwise action can be taken against OP under Section 25 / 27 of the Consumer Protection Act.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
