The factual matrix leading to complaint is that overdraft service was availed from OP Bank which was stopped without intimation on 17.3.2010. A legal notice was sent on 21.9.2011. The complainant had to undergo severe difficulties in his business due to closure of OD account and this complaint was filed.
OP in its version has stated that since minimum payment was not made in the account, the OD facility was withdrawn. Emphasis was laid on clause 4 of agreement which states that Bank can stop the credit facility at any time. However, OP Bank alleges that it has sent prior intimation to Complainant vide letter dated 25.1.2009.
Scrutiny of pleading and correspondence reveals that over draft facility and its withdrawal is admitted by both parties. Complainant has not rebutted the allegation made by OP by not filing rejoinder. OP Bank was within its right to withdraw overdraft facility. The complaint is hence dismissed.
