This appeal coming on before us for hearing today, this Commission made the following order in open court :-

No representation for appellant. Respondent present. As per the order of this Commission dated 25.11.2019, the appellant was imposed a cost of Rs.500/- to be paid to the Respondent’s counsel on or before 5.2.2020. But till today the cost is not paid. The appellant also neither appeared nor represented. Today also the matter is posted for appearance of appellant and for reporting compliance or for dismissal. Respondent counsel would submit that he has not received the cost. Moreover it is submitted by the Respondent counsel that they have complied with the order of the District Commission by making a payment of Rs.35,000/- to the appellant/complainant. The matter was passed over till 1.45 am and called twice, the appellant neither represented nor present, thereby showing that the appellant is not interested in prosecuting the case. The appeal is of the year 2016. Therefore no useful purpose will be served in keeping the appeal on file. Hence the appeal is dismissed for default. No cost.
