ORDER

Before the State Commission appellant was proceeded ex parte.  Appellant filed an application for setting aside of the ex parte order which was dismissed by the State Commission for want of jurisdiction.  Subject to payment of Rs. 30,000/- to the respondent towards costs, limited notice was ordered to be issued to the respondent to show cause as to why the impugned order be not set aside and the case remitted back to the State Commission for a fresh decision in accordance with law.  Rs. 10,000/- were also directed to be paid to the respondent to meet the litigation and other allied expenses which were to be de hors the result of the appeal.

          Costs of Rs. 30,000/- as well as the litigation expenses have been paid to the respondent.     

          Limited notice issued to the respondent is made absolute.  Order of the State Commission ordering ex-parte proceedings against the petitioner is set aside and the case is remitted back to the State Commission to decide it afresh in accordance with law after affording an opportunity of filing the written statement and leading evidence to the appellant.

         

Parties are directed to appear before the State Commission on 06.09.2013.
