Today is fixed for hearing the petition dated 09/06/2023 filed by the Complainant which registered as M.A case no. 148/2023 dated 17/08/2023. Ld. Advocate for the Complainant is present. Petition is taken up for hearing. Heard Ld. Advocate for the Complainant. Perused the petition.

It has been stated in the petition that O.P No. 2 namely Dilip Deb has expired leaving behind his wife namely Uma Deb as sole legal heir. Ld. Advocate for the Complainant submits that after receipt of a Lawyer’s notice dated 14/03/2023 they came to learn that O.P No. 2 namely Dilip Deb has expired   leaving behind his wife namely Uma Deb as sole legal heir. He further submits that they could not collect the date of death as O.P No. 2 was resided in a far place.

Considering the entire matter, petition is allowed for the ends of justice. Legal heirs of O.P No. 2 namely Uma Deb be substituted in place of O.P No. 2. Complainant is permitted to file amended form of petition of complaint.

 To 27/12/2023 for filing amended form of petition of complaint and filing requisites in respect of the substituted O.P.

M.A. case no. 148/2023 is thus disposed of.
