Present : Complainant.  None for OP.

Arguments  heard.

The complaint purchased a pair of shoes from the OP shop by paying Rs.390/- vide receipt dated 15.11.13 Ext.1/A.  The same got damaged as heal came out. He went back to the shop of OP within a week and brought to the notice of the OP the defects and requested them to replace the shoes as it has 6 months warranty vide receipt No.T48/00310074 Dated 15.11.2013.  But the OP declined to replace and complainant sent a letter date 2.1.2014, Ext.CW1/C.  The OP, despite service of court notice did not appear and was preceded ex-parte.  We have considered the ex-parte evidence filed today which proves the case of complainant.  Keeping in view the adamant attitude of the OP and not responding to the Court Proceedings and not explaining the matter before the Court, we, therefore, hold OP guilty of deficiency in service and unfair trade practices.  We award compensation of Rs.3,000/- inclusive of litigation charges and replacement charges to the complainant, to be paid by OP.

The order shall be complied with within 30 days of the receipt of the copy of the order; otherwise action can be taken under Section 25 / 27 of the Consumer Protection Act.

Copy of the order be sent to the parties free of cost.
