Today is fixed for filing show cause by the complainant.

Order dated 20.12.2021 reveals that the said date was fixed for adducing evidence by the complainant.

On the said date the Ld. Advocate appearing for the Op 1 to 3 by filing an application prayed for disposal of this complaint on the ground that the dispute of the complainant had already been settled out of court by way of amicable settled in between the parties on 30.11.2021.

The said application was supported by a copy of the letter dated 30.11.2021 addressed to the director of Soumita Construction Pvt. Ltd.

It was submitted by the Advocate for the Op 1 to 3 in view of amicable settlement the complainant is found absent without taking any step.

Inspite of abovementioned submission by the Ops, supported by a copy of the letter this Ld. Commission being not satisfied directed the complainant to show cause as a last resort on the ground that as to why the case will not be dismissed due to her absence. The record was fixed on 21.01.20222. On 21.01.2022 the complainant remained as usual absent. Next date was given on 04.03.2022. On 04.03.2022 also complainant remains absent. Subsequently telephonic communication was made with the Ld. Advocate of the complainant from the end of this office of this Ld. Commission, the Ld. Advocate informed the office that as the complaint has already been settled, he is no more in this record. On being asked the Ld. Advocate provided the telephone number of the husband of the complainant. The Office of this Ld. Commission contact with him over telephone, the office came to know that as the dispute of the complainant has already been settled, complainant is not interested to be present further before this Ld. Commission.

In view of such information given by the husband of the complainant, we are of the view that as the grievance/dispute of the complainant had already been settled out of the Commission by way of amicable settlement, hence there is no bar to dispose of this complaint.

Hence it is ordered that the Consumer Complaint being no. RBT/CC/56/2021 is hereby dismissed for non-prosecution. Considering the facts and circumstances there is no order as to cost.

Let plain copy be given to the parties, free of cost as per CPR.
