The complainant along with his advocate as well as advocate for O.P.No.1 is present and filed a memorandum of settlement memo. Without prejudice to merits of the case M/s Samsung India Electronics Pvt. Ltd has entered into an out of commission settlement with the complainant. The consumer complaint is allowed for Rs.31,900/- only payable by the O.P.No.1 for goods refrigerator within 45 days positively hence as per terms of the compromise. The joint compromise memo shall form part of the award. The complainant agreed with said offer of M/s Samsung India Electronics Pvt. Ltd in full and final settlement of the case and agreed for closure of the case in terms of this Memorandum of settlement. Heard the memorandum of settlement memo and allowed it.
In the result I direct the O.P.No.1 to pay Rs.31,900/- only to the complainant within 45 days from receipt of this order.
The case of the complainant is disposed of accordingly.
The Learned Member(W) is on duty at Dist. CDR Commission, Gajapati at Paralakhemundi on 09.09.2023.
