          None is present for the appellant.  Respondents are not yet served.  On 12/08/2010 junior of Advocate Mhatre was absent since he was sick and therefore, Advocate Mr.Mhatre wanted time to produce packets which bore remarks “left” and then on 27/09/2010 Counsel for the appellant sought adjournment to take effective steps to supply correct address.  So, we directed issuance of fresh notice by RPAD and that we had directed him to take steps within 7 days, but Office note mentioned that appellant has not come with the required papers for service and notice was not issued.  There was lapse on the part of Advocate.  On 15/11/2010 Advocate Mr.Mhatre again sought time to take appropriate steps, but it appears that he has not taken any steps.  In the circumstances, we pass the following order :-

                   -: ORDER :-

1.       Appeal stands dismissed for non-prosecution and for default.

2.       No order as to costs.

3.       Copies of the order be furnished to the parties.
