This case record is taken up for consideration for passing order in respect of MA application filed by the petitioners / applicants on the ground that the complaint case being no.CC-247/2022 is not maintainable.

This matter has been contested by the OPs by filing written objection.

Heard argument of both sides considered submission.

Perused the MA application and also examined the written objection filed by the OPs.

On close examination of the material of this case record and also of the case record of CC-247/22 it is revealed that the complaint case has been filed by Sri Biswanath Pal and 3 others against the OPs M/s S.T. Developers and 2 others and this MA case has also been filed by Sri Biswanath Pal and others who are actually complainant of the above noted complaint case.  It is very astonishing that complainants of CC-247/22 as petitioners have filed this MA case on the ground that the complaint case is not maintainable.  This matter is clearly absurd.  It is crystal clear that cause title of the MA application is defective.

Considering the above noted factors the MA application is dismissed on contest. 

No order is passed as to cost.

In the light of the observation made above this MA case is disposed of.
