Today is fixed for S/r and appearance.

The Ld. Advocate of the complainant is present. The complainant is also present in person. One application seeking dismissal of the case on the ground that the matter has been settled out of court amicably and that the claim of the complainant has been satisfied. The OP have satisfied the claim of the complainant by making payment of Rs. 3, 00,000/-. The OP have not entered appearance in this case so far. This is the complainant who has set the law in motion giving rise to the registration of this case and it is his prerogative that he can back out at any stage of this case. Therefore, the prayer made by the Ld. Advocate of the complainant for withdrawal of the case is accepted.

Hence it is ordered that the case be and the same is dismissed as withdrawn.

There will be no order as to costs.

The Ld. Advocate of the complainant will get the copies of documents which he has filed in support of this case.
