It seems from prayer that complainant is seeking direction to OP to hand over the possession of fully developed flat without paying enhanced External Development Charges for a sum of Rs.2,08,290/- which was demanded by OP and for some relief of Tax, penalty etc.

It is stated by OP Counsel that construction is complete and occupancy will be given after obtaining completion certificate.

We have gone through the pleadings, reply, and evidence and find that complainant is staying away from paying EDC and other charges and want possession of flat without paying it. Such a complainant approach shows no deficiency on the part of OP and OP is ready to pay delay charges by adjusting it towards final demand.

The Complaint is disposed off with direction to OP to offer possession of flat after adjusting delay charges towards final demand and only after the total amount is deposited by Complainant with OP.

There is no case for compensation, penalty or litigation.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
