IA/97/2019 is taken up for hearing.

Heard both sides. Considered.

The instant IA Case relates to an application for condonation of delay.

It is stated that the impugned judgement was passed on 30.09.2019 and an application for certified copy was made on 01.10.2019 and certified copy was also received on that very date. Thereafter, Puja Vacation started from 02.10.2019. The Appeal is ultimately was filed on 13.11.2019 and there was a delay of 13 days in filing the Appeal. The Appellant prays for condonation of the delay.

Ld. Lawyer for the respondent does not raise any objection and submits that he has no objection if condonation petition is allowed and the Appeal is heard on merit.

We find that the delay in filing the Appeal was for a span of only 13 days.

The delay is condoned.

Hence,

                                    ORDERED

IA/97/2019 is allowed on consent and also on merit.
