FINAL ORDER

The record reveals that this complaint was filed by the Complainants on 29.09.2016. The complaint was admitted on 19.10.2016. On 19.12.2016 the complaint was fixed for S/r and appearance of the OP. On that date from the track report it was evident that the OP did not receive the notice and next date was fixed for S/r and appearance of the OP on 07.02.2017. The Complainants were directed to take necessary steps in respect of servicing of notice upon the OP. On 07.02.2017 time was given to the Complainants for publication of notice in the newspaper. Next date was fixed on 30.03.2017. Since 30.03.2017 the Complainants did not turn up before this Ld. Forum though several dates were given i.e. 03.05.2017, 21.06.2017, 05.09.2017 and 26.12.2017. As on 26.12.2017 the Complainants remained absent, on the said date the Complainants were directed to show cause as to why the complaint shall not be dismissed due to non-appearance of the Complainant. Date was fixed on 04.04.2018. On 04.04.2018 also the Complainants remained absent as usual. No cause is shown by the Complainants as per direction of this Ld. Forum. Under this circumstances we are of the view that the Complainants have lost their interest to proceed with the complaint. Therefore we have no other option but to dismiss the complaint.

Hence it is ordered that the Consumer Complaint being no-628/2016 is hereby dismissed for default.

Let plain copy of this order be given to the parties free of cost as per the provision of the CPR, 2005.
