Case Called twice, none appeared for appellant. Counsel for Respondent No.2 submits that they have settled the claim as per the terms and conditions of the policy and even there is no claim against them.  The complainant only alleged against R1.  The complaint before the District Commission came to be dismissed holding that there is no deficiency of service on the part of R2 and other Opposite Parties.     

On the other hand, the appellant did not address his arguments in spite of sufficient opportunities.  We consider the appellant is not interested in continuing the case. Mere filing of memorandum of appeal is not sufficient to hold the appeal in the absence of any arguments and convincement by the appellant. As such the appeal is liable to be dismissed.  Accordingly, the appeal is dismissed.

          Return the LCR forthwith to the concerned District Commission.

          Forward copy of this order to both parties as well as concerned District Commission.
