ORDER

The appellant has failed to appear since long after the matter is remanded by the Apex Court.  The appeal was enlisted for the purpose of hearing but the notice sent to the appellant returned unserved with the remarks that the appellant has left the address.  The insurance company was requested to furnish the address.  However, it appears that the insurance company also could not give the address.  The order dated 14-03-2011 shows that the notice was again sent to the appellant but it was returned back with postal remarks “addressee deceased”.   By the order  dated 27-04-2011, the Registrar directed listing of the appeal before the Bench for further directions.  By order dated 15th July, 2011, copy of the said order was sent to the appellant for information.  Though such notice was sent yet again it has been returned with postal remarks that the place of the addressee was found locked.  The appeal is old one and there appears no prosecution thereof by the counsel for the appellant or any one from the side of the appellant.  Consequently, the appeal is dismissed in default.
