The Complainant purchased a vehicle bearing registration no.DLIVB-4963 (Tavera) and got it insured from OP1 from 09.03.07 to 08.03.08 and finance from OP2. The said vehicle was stolen on 03.07.15 and a claim was filed. The claim was not settled and complaint was filed.

OP1 stated that cheque no.315932 dared 23.03.07 for a sum of Rs.19,011/- was given towards payment of premium and a cover note was issued in lieu of this cheque. The cheque was dishonored on 07.04.07 with memo insufficient fund.  Memo annexed. Same was intimated to complainant vide letter dated 10.04.07 and policy was duly cancelled. The letter is annexed with the complaint.

We have perused the pleadings and considered the argument. It is clear that premium was not paid and as such there is no contract of insurance between complainant and insurance company.

Thus, there is no obligation on insurance company to settle the claim and complaint is dismissed being devoid of any merits.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
