Mr. Surinder Singh Sidhu, Adv. for Decree Holders- complainants has suffered following statement:-
“Stated that Decree Holders-complainants have received amount of Rs.2,90,00,000/- (Two Crores, Ninety lacs only) in the execution as per the order of this Hon’ble Commission dated 24.01.2023 as full and final payment from Judgment Debtors-opposite parties No. 1 & 2. Hence, on instructions of Decree Holder-complainants, the order of this Hon’ble Commission has been fully satisfied and the same may be disposed of as such. It is further stated that the requisite original paper of the flat No.C-033, Revanta, Gurugram, Haryana will be returned to the JDs. It is further stated that Decree Holders-complainants has no objection, for the release of the accounts attached vide order dated 17.05.2024 or any other accounts/FDRs attached by the orders of this Hon’ble Commission”.
2. Necessary implications flowing from this quality statement is that: claim of Decree Holders-complainants raised through Execution Application No.35 of 2023 stands fully satisfied. Decree Holders-complainants will abide by above statement of their counsel to return requisite original paper of the flat No.C-033, Revanta, Gurugram, Haryana to JDs, which, as corollary so flowing, would also be treated as cancelled.
3. It is now ordered that: three accounts No. 017105010938, 017105010947 & 017101500033, ICICI Bank, E-30, Saket, New Delhi-17, are ordered to be released from attachment forthwith.
4. Similarly, properties eight in numbers (i.e. accounts / FDRs) are also ordered to be released from attachment forthwith. Details of these accounts / FDRs now ordered to be released from attachment are as under:-
