        The complaint of deficiency alleged is in relation to flat booked C-2/501 in “Raheja Residential Complex” in Jaipur by Complainant. It is alleged that she has paid Rs.22,50,000/- in different installments to OP, as per demand, but the project was delayed and despite paying more than the agreed amount, the OP issued a further demand of Rs.3 lakhs on 28.09.12. It is also alleged that though possession was offered, it was incomplete in many respects. The OP filed a reply stating in Para5 of preliminary objection that the complainant had not paid the outstanding amount, on account of various other charges and that it was ready to execute the registry of flat, as has been done for other buyers, who have taken possession. The rejoinder filed by complainant has not rebutted the balance outstanding and is a bald denial of all reply.

        We have considered the rival contentions and find that there is no deficiency on the part of OP, in demanding the balance outstanding for giving possession. In respect of delay etc., the same is governed by the terms of agreement signed, and if the same is not complied, complainant has liberty to file fresh complaint of deficiency, when made out.

        In view of the above discussion, the complaint is dismissed.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
