PER MR. JUSTICE A.P.BHANGALE, HON’BLE PRESIDENT.
1. Heard Mr. Burde, learned advocate for the complainant. He has already tendered written notes of argument and complaint proceeded exparte against the O.P. as O.P. remained absent. According to Mr. Burde, learned advocate for the complainant there was agreement between the parties whereby the O.P. M/s. Prime Infra and Resorts, Nagpur through their partner agreed to perform certain acts in consideration of Rs. 19,22,000/- duly acknowledged in the receipt dated 15/04/2015. The O.P. has promised as a expert to develop and provided amenities in respect of agricultural land admeasuring about 1.41 H. Are. The land situated at Mauza Aakewada( Rithi), Talathi Serial No. 67, Taluka Katol, District Nagpur. The O.P. had agreed to partition the land in two distinct area and to convert dry land into irrigated land or non agricultural land and took steps to provide various amenities such as Club House , Swimming Pool, Indoor and Outdoor Games, Health Club/Gym, Garden and Them Park, Children Park, Sports Club as agreed. The O.P. shall also make plantation of 40 Mango and Chicku trees or any other trees was to be made as also grass lawn with Metallic main gate and construction of Farm House etc. for consideration of Rs. 19,22,000/- duly received by the O.P. under term receipt. However, despite legal notice dated 26/09/2017 and 09/10/2018 the O.P. indulged in to unfair trade practice and deficiency in service by violating the agreement and continued to make empty promises to the complainant and also failed to refund amount as demanded under the legal notice.

According to the complainant the O.P. has deliberately failed to appear before the State Consumer Disputes Redressal Commission as notice issued to the O.P. at his last known address was returned with endorsement as “Left” and the complaint proceeding proceeded exparte against the O.P. Under the facts and circumstances, we allow this complaint as under.
ORDER
i. It is therefore declared that the O.P. has indulged into deficiency in service and unfair trade practice.
ii. The O.P. is directed to perform various acts as contemplated under the agreement dated 15/04/2015 for consideration of Rs. 19,22,000/- already received by the O.P. under term acknowledgement receipt .
iii. In the event the O.P. fails to perform requisite acts within the period of 90 days from the date of this order, the O.P. shall refund the amount of Rs. 19,22,000/- together with interest at the rate of 12% p.a. from the date of respective payment till realization.
iv. The. O.P. is also directed to pay compensation in the sum of Rs.2,00,000/- for deliberate failure to perform acts and for causing mental and physical harassment to the complainant.
v. O.P. shall also pay sum of Rs. 25,000/- as cost of litigation to the complainant.
vi. The complaint is partly allowed accordingly.
