ORDER

1.       This appeal filed under section 19 of the Consumer Protection Act 1986 is in challenge to the Order dated 07.07.2021 of the State Commission in complaint no. 214 of 2019.

2.       Cross appeal no. 532 of 2021 filed by the respondent builder co. titled as Parsvnath Developers Ltd. vs. Kartar Singh against the same impugned Order 07.07.2021 arising out of the same consumer complaint no. 214 of 2019 has already been dismissed as withdrawn as the respondent (builder co.) has given assurance that it will comply with the impugned Order in its entirety.

3.       Learned proxy counsel for the appellant (complainant) submits, on instructions, that the appellant (complainant) does not wish to pursue this appeal in the wake of fact that connected cross appeal no. 532 of 2021 filed by the respondent (builder co.) against the same impugned Order already stands withdrawn and the respondent (builder co.) has given assurance to comply with the impugned Order of the State Commission in its entirety.

4.       In the wake of submissions made on behalf of the appellant (complainant), the appeal no. 232 of 2022 stands dismissed as withdrawn. Concomitantly, unconditional liberty is granted to the appellant (complainant) to revive his appeal if he on advise so wishes within 60 days from today by filing appropriate application.

5.    The Registry is requested to send a copy each of this Order to the parties in the appeal and to their learned counsel immediately. The copy of the order be also communicated to the State Commission forthwith by fastest mode available. The stenographer is requested to upload this Order on the website of this Commission immediately.
