The Complainant had booked a plot measuring 160 sq. yds in Pal Green City, Neem Rana on payment of Rs.1,35,000/- as per annexure C2 and agreement between the parties and acknowledgment cum receipt dated 26.08.06 was issued by OP, is annexed as Exh.C3 & C4. OP sent a demand letter dated 18.04.2000 where in it offered provisional allotment and also informed the complainant about receiving requite sanction. The Complainant sent several letter dated 24.01.09, 30.05.11 along with legal notice dated 23.07.11 requesting details of sanctions/approvals by competent authorities or refund of amount deposited (All correspondences along with POD annexed). OP has paid no heed to genuine grievance of complainant as no other recourse was available, the complaint was filed. Notice was issued but OP failed to appear and therefore was proceeded exparte.
Exparte evidence clearly depicts that OP arbitrarily remained silent after collecting money from various consumers except false assurance given by OP. Neither plot in question was in existence nor any approval from competent authority for the project called “PAL City NeemRana” which is a clear case of unfair trade practices on the part of OP who fraudulently cheated the sentiments of cheated public and exploited the innocent people which fall under preview of Criminal Act.
Keeping in view, OP is directed to refund Rs.1,35,000/- along with 12% interest from the date of deposit till realization. We award Rs.35,000/- as litigation expenses.
The order shall be complied by OP1 within 30 days of the receipt of the copy of the order; otherwise action can be taken under Section 25 / 27 of the Consumer Protection Act.

Copy of the order be sent to the parties free of cost.
