            The case of the complainants is that first complainant is the holder of universal health policy from the opposite parties and he is claiming Rs.51,686/- from the said policy, but it was repudiated by the opposite parties.  He says deficiency of service on the part of the opposite parties.  Hence the present complaint. 

            2.  The  opposite parties contended that  there is no deficiency in service on the part of them, since the policy issued is not one in continuation of any earlier policies or a renewal of any policies.  According to them a new policy, on the basis of proposals,  was issued.   More  over the other policy expired one month prior of above policy.  According to them records produced by the complainant disclosed the pre-existence of the ailment.  Hence repudiation of the claim is justifiable.     

3.   On the side of the complainants 2nd complainant was examined as PW1 and Exts.A1 to A7 marked.  On the side of the opposite parties Exts.B1 to B5 marked.

4.  We have gone through the  pleadings, records and  all the evidences adduced by the parties.  Here sole question is to be decided that there is any pre-existence of ailments, the complainant who had undergone treatment admittedly suffering from same diseases from 2000 onwards and present claim is hit by exclusion clause 4(1) and 4(2) of policy conditions.  Hence there is no deficiency in service on the part of the opposite parties.

            In the result, complaint dismissed.  No order as to costs.
