ORDER

Memo of settlement duly signed by petitioner as well as Respondent no.1 has been filed. Same is ordered to be placed on record. As per terms of the settlement, both these parties have settled the matter with their own free-will without any coercion and misrepresentation. Accordingly, memorandum of settlement filed by them is accepted. Both these parties shall be bound by the terms of settlement which reads as under; . The Parties have mutually agreed that the First Party shall refund to the Second Party the total amount of Rs.14,22,539/- only by way of four drafts the details of which are as follows; a) DD No.018043 dated 18.3.2013 for an amount of Rs.4,78,597/- drawn on Axis Bank in the name of Sandeep Saxena. b) DD No.018042 dated 18.3.2013 for an amount of Rs.5,000/- drawn on Axis Bank in the name of Sandeep Saxena. c) DD No.018044 dated 18.3.2013 for an amount of Rs.1,39,361/- drawn on Axis Bank in the name of Sandeep Saxena. d) DD No.018041 dated 18.3.2013 for an amount of Rs.7,99,581/- drawn on Axis Bank in the name of Dewan Housing Finance Corporation Ltd. 2. It has been further agreed that on the instructions and on behalf of Second Party the amount of Rs.7,99,581/- by way of DD No.018041 is being made in the name of Dewan Housing Finance Corporation Ltd. out of the total amount to be paid to the Second Party. 3. The Second Party acknowledges the receipt of the amount of Rs.14,22,539/- by way of above mentioned Demand Drafts. 4. That on the signing of the Deed the parties has amicably resolved all their pending disputes. The Second Party further undertakes that the Second Party shall appear before the Hon’ble National Commission and state on oath that the dispute has been settled and shall withdraw the Revision Petition No.1876 of 2011. 5. That booking of the Second Party stand cancelled and hence forth there shall be no claim against the First Party its associate companies, Directors, officials and staff. 6. The Second Party on the signing of this Deed further undertakes to withdraw all claims, notices letters and complaints, be it civil or criminal which were made before the Courts, Forums, Police Stations, any other authority. 7. The parties hereby specifically agree and confirm that they shall bound by the terms hereby agreed and neither of them shall have the right to alter, amend or revoke any terms of this Deed. In view of the aforesaid settlement, the present revision petition stands disposed of, being settled.
