While allowing complaint filed by the petitioner by the order dated 02.07.2007, the District Forum had directed the respondents / opposite parties to deliver a new handset of GSM Nokia 6600 or upgraded model sealed and packed to the petitioner without any charges and to issue fresh warranty. Dissatisfied with the order of Forum, the petitioner filed appeal which was decided by the State Commission, Delhi vide order dated 02.02.2009, modifying the order of District Forum to refund the cost of the handset of Rs.12,020/- and pay Rs.2500/- as compensation. Still dissatisfied by that order, the petitioner filed this revision petition. On instructions from respondent no. 1, manufacturer Shri Aggarwal states that respondent no. 1 without prejudice is willing to pay Rs.10,000/- instead of Rs.2500/-, as compensation to the petitioner. This amount is in addition to the amount which is to be refunded of the price of mobile set. On instruction from the petitioner Shri Pathak states that petitioner is willing to accept Rs.10,000/- as compensation and revision petition may be disposed of accordingly. In terms of this settlement the, revision petition is disposed of with direction to pay total amount of Rs.22,020/- to the petitioner. This amount shall be paid by respondent no. 1 within two weeks failing which petitioner will be entitled to interest on the said amount @ 10% per annum. DASTI.
