         The complaint is regarding premium paid on mediclaim policy.  The father of the complainant expired on 3/8/2013. Thereafter, premium of Rs. 29,873/- was charged from the complainant. The name of complainant’s father was also included in the list of person insured.  The complainant filed a complaint praying for refund of premium and compensation.

 

OP has stated in its WS that policy issuing office was situated in Chennai and complainant himself is a residence of UP and consequently there is a lack of jurisdiction.

 

OP has further stated that the intimation of death was given after the renewal of policy and the premium has been refunded.

 

     We have heard the arguments paced by both parties. The complainant being based in UP and policy being insured from Chennai, no cause of action has arisen within Delhi.

 

     Ever on merits, complainant has been refunded the premium which was charged by OP.

    

     The complaint is hence dismissed and file be consigned to Record Room.
