Present: complainant and OP-3.
Argument heard
The brief facts are that complainant purchased a policy for his vehicle bearing registration number DL9CAC1291 from 21.7.2011 to 20.7.2011. The vehicle was damaged on 11.5.2012 at 10.30 pm when it crossed over, heaps of sand and gravel lying on the road. The said vehicle was towed away by OP-2 in the intervening night of 11.5.2012- 12.5.2012. Job sheets and bills of OP-2 are annexed with complaint. The complainant filed a claim and several correspondences were annexed. OP-1, Insurance Company sent a discharge voucher of Rs.2,256/- to the complainant. The complainant thereafter filed present complainant.
OP-1 appeared but failed to file WS. OP-1’s defense was stuck off on 11.7.2015.
We have given due consideration to arguments placed by complainant, pleadings documents and correspondence on record. Complainant’s vehicle was insured with OP-1 during the relevant period. Tow Bills and repair bill of complainant amounting to Rs.2000/- and Rs.55,831/- respectively are annexed with the complaint. OP has also sent a discharge voucher for Rs.2,256/- dated 8.1.13. OP in its various correspondence, including the covering letter for discharge voucher has nowhere specified or given any plausible explanation for settling the claim for Rs.2,256/- against the bill of Rs.57,831/-.
We, therefore, find OP1 guilty of imperfection in service for arbitrary and whimsical settlement of claim for a paltry amount of Rs.2,256/- and direct it to pay Rs.57,831/- with 9% interest from date of claim till realization. We also award Rs.25,000/- as compensation for harassment, mental trauma, inconvenience inclusive of litigation expenses.
The payment be made within 30 days of the receipt of the copy of the order; otherwise action will be taken under Section 25 / 27 of the Consumer Protection Act.
File be consigned to record room.
Copy of the order be sent to the parties free of cost.
