Complainant/applicant filed a complaint before the District Forum, Haridwar against the respondent/opposite party.  District Forum allowed the complaint.  Respondent being aggrieved filed the appeal before the State Commission, Uttarakhand.  Order passed by

the District Forum was upheld by the State Commission in the appeal.  Revision petition filed before this Commission was also dismissed.

          Since the order of the District Forum was not complied with, applicant/complainant filed the Execution Application before the District Forum at Haridwar.  Applicant has filed the present Transfer Application seeking transfer of the execution proceedings from District Forum Haridwar to District Forum at Delhi as he is unable to travel to Haridwar because of his old age.  It is also stated that the respondents is located in Delhi.

          Notice was issued to the respondent.  Respondent has not filed any reply.  Counsel for the respondent is also not present. 

          Since the applicant/complainant because of old age is not in a position to travel to Haridwar and the respondent is also living at Delhi, we deem it appropriate to transfer the execution proceedings filed by the applicant before District Forum at Haridwar to District Forum No.1 in Delhi.

          District Forum at Haridwar is directed to transfer the file of Execution Proceedings in the case No.123/2000 to District Forum No.1 in Delhi.

          Parties through their counsel are directed to appear before the District Forum No.1 in Delhi on 26.11.2012.

          Copy of this order be sent to the respondent to enable them to appear before the District Forum No.1 in Delhi on the date fixed.
