The complainant filed this case with the allegation that the complainant booked for purchasing the new model car, 2017 named is DUTSUN GO PLUS CAR and booked the car by paying Rs.25,000/- against Rs.5,21,901/- The complainant also handed over the old car to the o.p.no.1 who purchased the said car and agreed the value of Rs.98,125/-. The complainant paid further amount but the o.p. did not deliver the vehicle for which the complainant filed this case praying for direction upon the o.p.no.1 to return the amount of Rs.1,24,904/- and also for direction upon the o.p. for cancellation of the notice issued by o.p.no.2.

            On perusal of the  complainant it appears that the complainant is a Travel Service Firm and no where it has been mentioned that the said firm is being represented by any proprietor  or the said proprietor did said the travel service for the purpose of self-employment, since from the four corners  of the complainant it appears that the complainant is involved in commercial activities to run the travelling service. Therefore we hold that the case filed by the complainant does not attract as per provision laid down u/s 21(d) of C.P.Act. Accordingly we hold that the case filed  by the complainant is not maintainable and the same is dismissed in limini.
